Terms of Service

1.Acceptance of these terms

All rights, obligations and liabilities of you and Bibaho Network in connection with the service are governed by this agreement. We may change these terms from time to time at our discretion. To use the service you must register as a member and agree to be bound by these terms. By using the website you confirm that you have the right, authority and capacity to enter into this agreement.

2.Eligibility

Members must be of legal marriage age under the laws of Bangladesh. Registration or use by anyone below that age is unauthorised and a breach of these terms.

We act on the information you submit, believing it to be true and accurate, and are under no obligation to verify it. If we believe you are not eligible or have misrepresented your eligibility, we may end your membership without refund.

3.Managing a biodata for someone else

Parents, guardians and professional matchmakers may create and manage biodatas for others, but only with the knowledge and consent of the person the biodata describes. The person concerned may later claim their biodata and take control of it. Creating a biodata for someone without their consent is prohibited.

4.Membership, packages and pricing

Creating a biodata and browsing are free. Some features, such as viewing complete biodatas beyond the free allowance, revealing contact details and requesting introductions, require a package. Current packages, their allowances and prices are shown on the Packages page.

Only complete biodatas are shown to other members, and viewing other biodatas in full requires your own biodata to be complete. Free viewing limits may apply as described on the website.

A package belongs to the biodata it was bought for, is valid for the period stated at purchase and cannot be transferred. When it expires, its remaining allowances end.

You may ask us to close your account at any time. A package you have bought stays active until the end of its period. If we end your membership because you breached this agreement, you are not entitled to any refund.

5.Account security

You are responsible for keeping your account and password confidential and for all activity under your account. Tell us immediately about any unauthorised use, and sign out at the end of each session.

You may not use the service to advertise or sell products or services to other members, or send chain letters or junk messages. It is a breach of these terms to use information obtained from Bibaho Network to harass, abuse or harm anyone, or to contact, advertise to or solicit any member without their consent.

We may refuse service, end accounts, remove or edit content, or cancel packages at our discretion.

6.Verification

We may verify profile information by contacting you on your registered mobile number or email, and may ask for a copy of a valid photo ID (such as an NID, driving licence or professional ID card). We do our best to keep the service free from scammers, but we cannot guarantee that everyone is who they say they are. Character and personal verification must be carried out by the interested parties themselves.

7.Content you post

You are responsible for everything you post. You must not post content that is defamatory, inaccurate, blasphemous, abusive, obscene, sexually oriented, threatening, harassing, racially offensive, illegal, or that infringes anyone's rights, including intellectual property rights.

The service is for marriage only; it must not be used for dating, flirting or casual friendship. Photos are watermarked and we take measures against their misuse. We may modify or suspend a biodata that contains objectionable content, or contact details placed in the wrong fields.

8.Contact details

Contact details are never shown publicly. They are shared only when the owner consents, either by approving access and a contact reveal, or by accepting a Bibaho introduction. You must not include phone numbers, addresses, email addresses or links in the free-text parts of your biodata. We do not guarantee that a member will respond on the contact details shared.

9.Your interactions with other members

You are solely responsible for your interactions with other members. Do not give your financial information (such as card, bank or mobile banking details) to other members, and take reasonable precautions, especially when meeting in person.

Bibaho Network is not liable for any damage, whether direct, indirect, special, consequential or incidental, arising from the conduct of any person in connection with the service, including bodily injury, emotional distress or financial loss resulting from communication or meetings with other members.

10.Prohibited activities

You agree not to use the service or the website to:

• impersonate any person, or misrepresent yourself, your age or your affiliation with anyone;
• use another member's account, or create a false identity;
• post or share any content we consider harmful, threatening, unlawful, defamatory, infringing, abusive, harassing, obscene, fraudulent, hateful or otherwise objectionable;
• collect contact information of other members, by any means, to send unsolicited communications;
• upload photos other than genuine photos of the person the biodata describes;
• publish any third party's private information, such as addresses, phone numbers, email addresses, social media or ID details, or financial information;
• promote pirated or unauthorised copies of anyone's copyrighted work;
• send advertising, spam, chain letters, pyramid schemes or any other solicitation;
• use robots, scrapers or automated scripts to collect information from, or interact with, the service;
• upload viruses or any code designed to disrupt, destroy or limit the functionality of any software, hardware or network;
• modify, sublicense, reverse engineer, decompile or otherwise attempt to extract the software used for the service;
• use the service unlawfully, or in any way that could damage, disable or overburden it.

11.Duplicate biodatas

Each person may have only one biodata on Bibaho Network, and each member only one account. If you forget your password, use password recovery instead of creating a new account. We may delete or restrict duplicate biodatas and accounts, including the original.

12.Payments

Payments are processed through bKash. Any fees charged by bKash are governed by bKash's own terms and are not controlled by Bibaho Network.

13.Licence and site access

We grant you a limited licence to access and make personal use of the website. You may not resell, reproduce, copy or commercially use the website or its content; download or copy member information for anyone else's benefit; use data mining, robots or similar tools; frame or mirror any part of the service; or use our name in meta tags or code to direct anyone to another website. Any unauthorised use ends this licence.

14.Disputes between members

You are solely responsible for your interactions with other members. We may, but are not obliged to, monitor disputes between members.

15.Changes to the service

We may modify or discontinue the service, or any part of it, temporarily or permanently, with or without notice, and are not liable to you or any third party for doing so.

16.Termination

All decisions about ending accounts are made at our discretion. We are not required to give notice before ending a membership, or to disclose the reason. These terms remain in effect after your membership ends, and terms that by their nature should survive will survive.

17.Refunds

Refunds are governed by our Refund Policy, published on this website.

18.No agency

Bibaho Network is a platform through which members exchange information to further their matrimonial objectives. We are not the agent of any member and do not take part in the exchange or its results.

19.Customer service

Our representatives may contact you by phone, SMS or email. To keep the service free from fraud we may review reports and account activity. When dealing with our representatives you must not be abusive, obscene, threatening, harassing or otherwise inappropriate; if you are, we may end your membership immediately without refund.

20.Indemnity

You agree to indemnify and hold harmless Bibaho Network, its affiliates, successors and assigns against all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees) arising from any breach of this agreement by you. You are solely liable for any breach of applicable laws or codes of conduct.

21.Disclaimer of warranty and limitation of liability

We make no representations or warranties of any kind about the operation of the website or its content. You use the website at your own risk. We are not liable for any damages arising from its use, including direct, indirect, incidental, punitive and consequential damages, or for: any act or omission not done by us; incorrect information submitted by you or on your behalf; decisions based on information provided by other members; unauthorised acts of third parties; cybercrime; or any force majeure event.

In any case, our total liability to you is limited to the amount, if any, you paid us for the service during your membership.

22.Copyright

All content on this website, including text, graphics, logos, images and software, belongs to Bibaho Network or its content suppliers and is protected by copyright law. Our trademarks may not be used in connection with any product or service that is not ours, or in any way likely to cause confusion or to discredit us.

If you believe your rights have been infringed on the website, write to bibahonetwork@gmail.com with: your signature (electronic or physical); a description of the work and where the infringing material appears; your address, phone number and email; a statement of your good-faith belief that the use is unauthorised; and a statement that your notice is accurate and that you are the owner or authorised to act for the owner.

23.Privacy and confidentiality

Your use of the website is also governed by our Privacy Policy. We keep members' personal information confidential and take all reasonable steps to protect it, but may disclose it where required by law. Information you submit may be retained as permitted by law, even after your membership ends.

24.Governing law and jurisdiction

These terms are governed by the laws of the People's Republic of Bangladesh. You agree to the exclusive jurisdiction of the courts of Dhaka for any dispute arising from the website or the service.

1.শর্তাবলী গ্রহণ

সেবা সংক্রান্ত আপনার ও বিবাহ নেটওয়ার্কের সকল অধিকার, বাধ্যবাধকতা ও দায় এই চুক্তি দ্বারা নিয়ন্ত্রিত। আমরা আমাদের বিবেচনায় সময়ে সময়ে এই শর্তাবলী পরিবর্তন করতে পারি। সেবা ব্যবহার করতে আপনাকে সদস্য হিসেবে নিবন্ধন করতে হবে এবং এই শর্তাবলী মেনে চলতে সম্মত হতে হবে। ওয়েবসাইট ব্যবহার করে আপনি নিশ্চিত করছেন যে এই চুক্তিতে প্রবেশের অধিকার, কর্তৃত্ব ও সক্ষমতা আপনার রয়েছে।

2.যোগ্যতা

সদস্যদের অবশ্যই বাংলাদেশের আইন অনুযায়ী বিবাহের বৈধ বয়সে পৌঁছাতে হবে। এর কম বয়সী কারো নিবন্ধন বা ব্যবহার অননুমোদিত এবং এই শর্তাবলীর লঙ্ঘন।

আপনার দেওয়া তথ্য সত্য ও সঠিক ধরে নিয়ে আমরা কাজ করি, এবং তা যাচাই করার কোনো বাধ্যবাধকতা আমাদের নেই। আপনি যোগ্য নন বা যোগ্যতা সম্পর্কে ভুল তথ্য দিয়েছেন বলে মনে হলে আমরা কোনো অর্থ ফেরত ছাড়াই আপনার সদস্যপদ বাতিল করতে পারি।

3.অন্য কারো পক্ষে বায়োডাটা পরিচালনা

বাবা-মা, অভিভাবক ও পেশাদার ঘটক অন্যদের জন্য বায়োডাটা তৈরি ও পরিচালনা করতে পারেন, তবে কেবল বায়োডাটায় বর্ণিত ব্যক্তির জ্ঞাতসারে ও সম্মতিতে। সংশ্লিষ্ট ব্যক্তি পরে নিজের বায়োডাটা দাবি (ক্লেইম) করে এর নিয়ন্ত্রণ নিতে পারেন। কারো সম্মতি ছাড়া তার বায়োডাটা তৈরি করা নিষিদ্ধ।

4.সদস্যপদ, প্যাকেজ ও মূল্য

বায়োডাটা তৈরি ও ব্রাউজ করা বিনামূল্যে। কিছু সুবিধার জন্য প্যাকেজ প্রয়োজন, যেমন বিনামূল্যের সীমার বেশি সম্পূর্ণ বায়োডাটা দেখা, যোগাযোগের তথ্য দেখা এবং ইন্ট্রোডাকশনের অনুরোধ করা। বর্তমান প্যাকেজ, সেগুলোর সুবিধা ও মূল্য প্যাকেজ পাতায় দেখানো আছে।

অন্য সদস্যদের কাছে কেবল সম্পূর্ণ বায়োডাটা দেখানো হয়, এবং অন্যের বায়োডাটা বিস্তারিত দেখতে নিজের বায়োডাটা সম্পূর্ণ থাকতে হয়। ওয়েবসাইটে বর্ণিত বিনামূল্যে দেখার সীমা প্রযোজ্য হতে পারে।

প্যাকেজ যে বায়োডাটার জন্য কেনা হয় সেটির জন্যই প্রযোজ্য, কেনার সময় উল্লিখিত মেয়াদ পর্যন্ত বৈধ থাকে এবং হস্তান্তরযোগ্য নয়। মেয়াদ শেষ হলে অবশিষ্ট সুবিধাও শেষ হয়ে যায়।

আপনি যেকোনো সময় আমাদের কাছে অ্যাকাউন্ট বন্ধের অনুরোধ করতে পারেন। কেনা প্যাকেজ তার মেয়াদ শেষ পর্যন্ত সক্রিয় থাকবে। চুক্তি লঙ্ঘনের কারণে আমরা সদস্যপদ বাতিল করলে কোনো অর্থ ফেরত পাবেন না।

5.অ্যাকাউন্টের নিরাপত্তা

আপনার অ্যাকাউন্ট ও পাসওয়ার্ডের গোপনীয়তা রক্ষা এবং আপনার অ্যাকাউন্টের সকল কার্যকলাপের দায় আপনার। কোনো অননুমোদিত ব্যবহারের কথা অবিলম্বে আমাদের জানান এবং প্রতিবার ব্যবহারের শেষে সাইন আউট করুন।

এই সেবা ব্যবহার করে অন্য সদস্যদের কাছে কোনো পণ্য বা সেবার বিজ্ঞাপন বা বিক্রয় করা যাবে না, চেইন লেটার বা অযাচিত বার্তা পাঠানো যাবে না। বিবাহ নেটওয়ার্ক থেকে পাওয়া তথ্য ব্যবহার করে কাউকে হয়রানি, অপব্যবহার বা ক্ষতি করা, অথবা কোনো সদস্যের সম্মতি ছাড়া তার সাথে যোগাযোগ, বিজ্ঞাপন বা অনুরোধ করা এই শর্তাবলীর লঙ্ঘন।

আমরা আমাদের বিবেচনায় সেবা প্রত্যাখ্যান, অ্যাকাউন্ট বাতিল, বিষয়বস্তু অপসারণ বা সম্পাদনা, অথবা প্যাকেজ বাতিল করতে পারি।

6.যাচাইকরণ

আমরা আপনার নিবন্ধিত মোবাইল নম্বর বা ইমেইলে যোগাযোগ করে প্রোফাইলের তথ্য যাচাই করতে পারি, এবং বৈধ ছবিসহ পরিচয়পত্রের (যেমন জাতীয় পরিচয়পত্র, ড্রাইভিং লাইসেন্স বা পেশাগত পরিচয়পত্র) কপি চাইতে পারি। সেবাকে প্রতারকমুক্ত রাখতে আমরা যথাসাধ্য চেষ্টা করি, তবে প্রত্যেকে তার দাবি অনুযায়ী ব্যক্তি কিনা তার নিশ্চয়তা দিতে পারি না। চারিত্রিক ও ব্যক্তিগত যাচাই আগ্রহী পক্ষদের নিজেদেরই করতে হবে।

7.আপনার পোস্ট করা বিষয়বস্তু

আপনার পোস্ট করা সবকিছুর দায় আপনার। মানহানিকর, ভুল, ধর্মীয় অবমাননাকর, অপমানজনক, অশ্লীল, যৌন ইঙ্গিতপূর্ণ, হুমকিমূলক, হয়রানিমূলক, জাতিগতভাবে আপত্তিকর, বেআইনি, অথবা মেধাস্বত্বসহ কারো অধিকার লঙ্ঘনকারী কোনো বিষয়বস্তু পোস্ট করা যাবে না।

এই সেবা কেবল বিবাহের উদ্দেশ্যে; ডেটিং, ফ্লার্টিং বা সাধারণ বন্ধুত্বের জন্য এর ব্যবহার করা যাবে না। ছবিতে ওয়াটারমার্ক দেওয়া থাকে এবং অপব্যবহার রোধে আমরা ব্যবস্থা নিই। আপত্তিকর বিষয়বস্তু থাকলে, অথবা ভুল ঘরে যোগাযোগের তথ্য দেওয়া হলে আমরা বায়োডাটা পরিবর্তন বা স্থগিত করতে পারি।

8.যোগাযোগের তথ্য

যোগাযোগের তথ্য কখনো প্রকাশ্যে দেখানো হয় না। এটি কেবল মালিকের সম্মতিতে শেয়ার হয়: অ্যাক্সেস ও যোগাযোগ দেখার অনুমোদন দিয়ে, অথবা বিবাহ নেটওয়ার্কের ইন্ট্রোডাকশন গ্রহণ করে। বায়োডাটার মুক্ত লেখার ঘরে ফোন নম্বর, ঠিকানা, ইমেইল বা লিংক দেওয়া যাবে না। শেয়ার করা যোগাযোগের মাধ্যমে কোনো সদস্য সাড়া দেবেন কিনা, তার নিশ্চয়তা আমরা দিই না।

9.অন্য সদস্যদের সাথে আপনার যোগাযোগ

অন্য সদস্যদের সাথে যোগাযোগের সম্পূর্ণ দায় আপনার। অন্য সদস্যদের আপনার আর্থিক তথ্য (যেমন কার্ড, ব্যাংক বা মোবাইল ব্যাংকিংয়ের তথ্য) দেবেন না, এবং যুক্তিসঙ্গত সতর্কতা অবলম্বন করুন, বিশেষত সরাসরি সাক্ষাতের সময়।

সেবা ব্যবহারের সাথে সম্পর্কিত কোনো ব্যক্তির আচরণ থেকে উদ্ভূত প্রত্যক্ষ, পরোক্ষ, বিশেষ, আনুষঙ্গিক বা পরিণতিমূলক কোনো ক্ষতির জন্য বিবাহ নেটওয়ার্ক দায়ী নয়, যার মধ্যে অন্য সদস্যদের সাথে যোগাযোগ বা সাক্ষাতের ফলে শারীরিক আঘাত, মানসিক কষ্ট বা আর্থিক ক্ষতি অন্তর্ভুক্ত।

10.নিষিদ্ধ কার্যকলাপ

আপনি সেবা বা ওয়েবসাইট ব্যবহার করে নিম্নলিখিত কাজ না করতে সম্মত হচ্ছেন:

• কারো ছদ্মবেশ ধারণ, অথবা নিজের পরিচয়, বয়স বা কারো সাথে সম্পর্ক সম্পর্কে ভুল তথ্য দেওয়া;
• অন্য সদস্যের অ্যাকাউন্ট ব্যবহার বা মিথ্যা পরিচয় তৈরি করা;
• আমাদের বিবেচনায় ক্ষতিকর, হুমকিমূলক, বেআইনি, মানহানিকর, অধিকার লঙ্ঘনকারী, অপমানজনক, হয়রানিমূলক, অশ্লীল, প্রতারণামূলক, ঘৃণ্য বা অন্যথায় আপত্তিকর বিষয়বস্তু পোস্ট বা শেয়ার করা;
• অযাচিত যোগাযোগের উদ্দেশ্যে যেকোনো উপায়ে অন্য সদস্যদের যোগাযোগের তথ্য সংগ্রহ করা;
• বায়োডাটায় বর্ণিত ব্যক্তির প্রকৃত ছবি ছাড়া অন্য কোনো ছবি আপলোড করা;
• তৃতীয় পক্ষের ব্যক্তিগত তথ্য, যেমন ঠিকানা, ফোন নম্বর, ইমেইল, সামাজিক মাধ্যম বা পরিচয়পত্রের তথ্য, অথবা আর্থিক তথ্য প্রকাশ করা;
• কারো কপিরাইটকৃত কাজের পাইরেটেড বা অননুমোদিত কপি প্রচার করা;
• বিজ্ঞাপন, স্প্যাম, চেইন লেটার, পিরামিড স্কিম বা যেকোনো ধরনের অনুরোধ পাঠানো;
• সেবা থেকে তথ্য সংগ্রহ বা সেবার সাথে যোগাযোগের জন্য রোবট, স্ক্র্যাপার বা স্বয়ংক্রিয় স্ক্রিপ্ট ব্যবহার করা;
• কোনো সফটওয়্যার, হার্ডওয়্যার বা নেটওয়ার্কের কার্যকারিতা ব্যাহত, ধ্বংস বা সীমিত করার উদ্দেশ্যে ভাইরাস বা কোড আপলোড করা;
• সেবায় ব্যবহৃত সফটওয়্যার পরিবর্তন, সাবলাইসেন্স, রিভার্স ইঞ্জিনিয়ার, ডিকম্পাইল বা অন্যভাবে বের করার চেষ্টা করা;
• বেআইনিভাবে, অথবা সেবার ক্ষতি, অকার্যকর বা অতিরিক্ত চাপ সৃষ্টি করতে পারে এমনভাবে সেবা ব্যবহার করা।

11.ডুপ্লিকেট বায়োডাটা

বিবাহ নেটওয়ার্কে প্রত্যেক ব্যক্তির কেবল একটি বায়োডাটা এবং প্রত্যেক সদস্যের কেবল একটি অ্যাকাউন্ট থাকতে পারে। পাসওয়ার্ড ভুলে গেলে নতুন অ্যাকাউন্ট না খুলে পাসওয়ার্ড পুনরুদ্ধার ব্যবহার করুন। আমরা মূলটিসহ ডুপ্লিকেট বায়োডাটা ও অ্যাকাউন্ট মুছে ফেলতে বা সীমিত করতে পারি।

12.অর্থপ্রদান

অর্থপ্রদান বিকাশের মাধ্যমে প্রক্রিয়া করা হয়। বিকাশের নেওয়া যেকোনো ফি বিকাশের নিজস্ব শর্তাবলী দ্বারা নিয়ন্ত্রিত এবং বিবাহ নেটওয়ার্কের নিয়ন্ত্রণের বাইরে।

13.লাইসেন্স ও সাইট ব্যবহার

আমরা আপনাকে ওয়েবসাইট ব্যবহার ও ব্যক্তিগত প্রয়োজনে ব্যবহারের একটি সীমিত লাইসেন্স দিই। ওয়েবসাইট বা এর বিষয়বস্তু পুনঃবিক্রয়, পুনরুৎপাদন, কপি বা বাণিজ্যিকভাবে ব্যবহার; অন্য কারো সুবিধার জন্য সদস্যদের তথ্য ডাউনলোড বা কপি; ডেটা মাইনিং, রোবট বা অনুরূপ সরঞ্জাম ব্যবহার; সেবার কোনো অংশ ফ্রেম বা মিরর করা; অথবা অন্য ওয়েবসাইটে লোক টানতে মেটা ট্যাগ বা কোডে আমাদের নাম ব্যবহার করা যাবে না। যেকোনো অননুমোদিত ব্যবহারে এই লাইসেন্স শেষ হয়ে যায়।

14.সদস্যদের মধ্যে বিরোধ

অন্য সদস্যদের সাথে যোগাযোগের সম্পূর্ণ দায় আপনার। সদস্যদের মধ্যকার বিরোধ পর্যবেক্ষণের অধিকার আমাদের আছে, তবে বাধ্যবাধকতা নেই।

15.সেবার পরিবর্তন

আমরা নোটিশসহ বা ছাড়াই সাময়িক বা স্থায়ীভাবে সেবা বা এর কোনো অংশ পরিবর্তন বা বন্ধ করতে পারি, এবং এর জন্য আপনার বা কোনো তৃতীয় পক্ষের কাছে দায়ী নই।

16.সমাপ্তি

অ্যাকাউন্ট বাতিলের সকল সিদ্ধান্ত আমাদের বিবেচনায় নেওয়া হয়। সদস্যপদ বাতিলের আগে নোটিশ দেওয়া বা কারণ জানানোর বাধ্যবাধকতা আমাদের নেই। সদস্যপদ শেষ হওয়ার পরও এই শর্তাবলী কার্যকর থাকে, এবং যেসব শর্ত প্রকৃতিগতভাবে বহাল থাকার কথা সেগুলো বহাল থাকবে।

17.অর্থ ফেরত

অর্থ ফেরত এই ওয়েবসাইটে প্রকাশিত আমাদের রিফান্ড নীতি অনুযায়ী পরিচালিত হয়।

18.কোনো এজেন্সি নয়

বিবাহ নেটওয়ার্ক একটি প্ল্যাটফর্ম, যার মাধ্যমে সদস্যরা বৈবাহিক উদ্দেশ্যে তথ্য বিনিময় করেন। আমরা কোনো সদস্যের এজেন্ট নই এবং এই বিনিময় বা এর ফলাফলে অংশ নিই না।

19.গ্রাহক সেবা

আমাদের প্রতিনিধিরা ফোন, এসএমএস বা ইমেইলে আপনার সাথে যোগাযোগ করতে পারেন। সেবাকে প্রতারণামুক্ত রাখতে আমরা অভিযোগ ও অ্যাকাউন্টের কার্যকলাপ পর্যালোচনা করতে পারি। আমাদের প্রতিনিধিদের সাথে অপমানজনক, অশ্লীল, হুমকিমূলক, হয়রানিমূলক বা অনুচিত আচরণ করা যাবে না; করলে আমরা কোনো অর্থ ফেরত ছাড়াই অবিলম্বে সদস্যপদ বাতিল করতে পারি।

20.ক্ষতিপূরণ

আপনার দ্বারা এই চুক্তির যেকোনো লঙ্ঘন থেকে উদ্ভূত সকল ক্ষতি, দায়, দাবি, খরচ ও ব্যয় (যুক্তিসঙ্গত আইনি খরচসহ) থেকে বিবাহ নেটওয়ার্ক, এর সহযোগী, উত্তরাধিকারী ও নিয়োগপ্রাপ্তদের ক্ষতিপূরণ দিতে ও দায়মুক্ত রাখতে আপনি সম্মত হচ্ছেন। প্রযোজ্য আইন বা আচরণবিধি লঙ্ঘনের একক দায় আপনার।

21.ওয়ারেন্টি অস্বীকার ও দায়ের সীমা
